Ethical misconduct in Marketing

INTRODUCTION:- While marketing has existed since the start of commercial trading, it has become more and more of a grey area for businesses in recent times. Questions that have been raised include: the blurred line between data collection and the invasion of privacy as well as the grey area between attracting consumers and deceptive advertisement. Businesses must be careful to tread on the right side of the line between legal and illegal. This blog will outline some of the common ethical and legal issues in marketing.

1. STEREOTYPING

Marketing campaigns often cast particular groups in stereotypical roles, such as washing powder advertisements that show women as housewives preoccupied with their laundry, or do-it-yourself marketing that seldom portray anyone other than men as being “handy.” In addition, the stereotypical impression created by much commercial marketing is that having an abundance of possessions will lead to fulfillment and happiness, but the opposing message is that the consumer will not be part of the happy group if he does not purchase the product.

2.Dealing with competitors:

Many companies advertise cheap prices as a “bait” and then once they draw in the customers, “switch” them over to a more costly product, because the advertised good was not available, insufficient or not of any value to the customer. Many online surveys and work at home opportunities use this unethical marketing technique. Predatory pricing or pricing beneath the competition so as to capture the market and restrict the competition is an unethical pricing strategy. And setting up barriers that prevent smaller companies from entering the market is unethical as well.
3.Data Collection and the Invasion of Privacy

Data collection is often considered the first, and most significant, stage of marketing. Extensive data allows businesses to choose the most optimal marketing techniques for their consumer base. In fact, companies such as Google and Facebook primarily rely on tracking a user’s web history to generate returns. This violates the privacy of users and is undoubtedly unethical.

4. Distribution of Data:-

Delivery channels such as telemarketing, door to door sales and unsolicited emails are some of the most controversial areas of marketing. For instance, we often get annoying phone calls from companies about their latest offers and discounts. Our email inbox is also filled with all types of junk mails from numerous websites. Companies try to reach their potential customer at any cost. However, the customer has to undergo a lot of unnecessary stress in this process.

5. Misleading Advertisements

Misleading claims in advertising may involve claims about the quality of the product, the availability of a service and any exclusions on a good. As examples, marketing techniques such as displaying appealing pictures of fast food disappoint the consumers when the actual product does not match their expectations.
A Code of Ethical Behavior for Marketing

When it comes to marketing, a code of ethics should be put in place that imposes ethical principles on marketing practices. First and foremost, it should be mandatory for marketers to adhere to all laws and regulations. Marketers should accept responsibility for the consequences of their actions, and ensure that their decisions and actions satisfy consumers. They should be honest and uphold dignity when serving consumers and make sure the products and services they are offering are safe and match consumers’ intentions. Marketers should also disclose risks associated with the product or service, and avoid false advertising and misleading tactics.
Every company’s marketing approach is different, so every company should have a strong ethical code to guide their marketing efforts. Marketers should refer to this code before and during every marketing campaign – otherwise the company risks a serious public, and perhaps even legal, backlash.

    1. In my perspective, ethics with profit is surely possible. If a company is ethical,it will attract more customers as everyone will have a good opinion about that company. In the long run as well, companies observing ethics earn more profits. Those who earn profits unethically are likely to incur heavy losses in the long run.
